Manhattan D.A. Bragg has announced the indictment of Eduardo Diaz, 42, for shooting his former boss on the Upper West Side last month. Diaz is being charged with Attempted Murder in the Second Degree, Attempted Assault in the First Degree, Assault in the Second Degree and Criminal Possession of a Weapon in the Second Degree.

“As alleged, Eduardo Diaz brutally targeted, shot and seriously injured his former employer in a broad daylight attack on a busy city street,” said District Attorney Bragg. “This alleged conduct not only endangered the life of the victim, but also brazenly disregarded the safety of Manhattanites both in the community and surrounding area – causing rippling effects for many New Yorkers as Mr. Diaz fled into the subway system with a firearm. My Office will continue to work in tandem with our law enforcement partners to combat gun violence and I wish the victim a swift recovery.”
Diaz had reportedly been fired from his job at Lincoln Business Machines (111 West 68th) and had sent his former boss, a 47-year-old man, threatening texts months before the shooting.
At about 9:15 a.m. on Thursday, November 7, Diaz went to the store and confronted his former boss. He initially tried to shoot him inside the store but his gun jammed. The confrontation spilled into the street where Diaz shot him multiple times at close range, even continuing to shoot him after he fell to the ground.
The victim was moved to an area hospital where he was treated for several days.
Diaz fled into the subway station at 72nd and Central Park West and escaped through the tunnels, but he was arrested the following day in Queens.
